These Terms of Service ("Terms") are a binding agreement between you and Ising Digital Sàrl ("we," "us") governing your use of the Snapari application and related services (the "App"). By downloading or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. By using it you represent that you meet this requirement and, if you are a minor in your jurisdiction, that you have your parent or guardian's permission. The App is not available to users under 13.
2. Your account
You may use the App as a guest or sign in with Apple. You are responsible for activity under your account and for keeping access to your device secure. We may suspend or terminate accounts that violate these Terms (see §12).
3. License to use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial entertainment, subject to these Terms. You may not copy, modify, reverse-engineer, resell, or build a competing service from the App, except where such restriction is prohibited by law.
4. Rolls (virtual currency)
- Rolls are a virtual, in-app resource used to capture creatures. Each capture consumes one Roll.
- Rolls and other virtual items have no monetary value, are not real currency or property, and cannot be redeemed for cash or transferred outside the App except where we expressly allow it in-app.
- We grant you a limited license to use Rolls within the App; we do not sell you ownership of them.
- We may add, remove, or change Roll grants, prices, monthly allotments, the free-tier trickle, and how Rolls are earned or spent, at any time, to balance the game and manage costs. Where a change is material and adverse, we will give reasonable notice.
- If a card generation fails for technical reasons, we will not unfairly consume the Roll for that capture (we credit or do not charge it).
- Rolls expire as described in-app: subscription allotments do not roll over between periods; separately purchased Rolls do not expire while your account is active.
5. Subscriptions and in-app purchases
- The App offers auto-renewing subscriptions (monthly and yearly) that grant a recurring Rolls allotment and other benefits, and consumable purchases (Roll packs), which are available to all users whether or not they subscribe.
- Billing is handled by Apple through your App Store account. Subscriptions renew automatically at the then-current price unless cancelled at least 24 hours before the end of the current period. Manage or cancel in your Apple ID settings.
- Prices and contents are shown in-app at purchase. We may change prices prospectively.
- Refunds are handled by Apple under its policies; except where required by law, purchases are non-refundable. Nothing in these Terms limits any non-waivable refund, cancellation, or withdrawal right you have under the consumer law of your country of residence.
- Restoring purchases is supported; entitlements are tied to your account/Apple ID.
- Deleting your account does not cancel your subscription. Subscriptions are billed by Apple under your Apple ID and keep renewing until you cancel them yourself in your Apple ID settings (Settings → Apple ID → Subscriptions). If you later create a new account, Restore Purchases re-attaches any still-active subscription to it.
6. Your cards and the "one-of-one" feature
- Each card you mint is assigned a globally unique serial, and we design the system so no two cards are identical. "One-of-one" describes scarcity within Snapari. It does not make a card real-world property, a security, an investment, or a blockchain/NFT asset, and it carries no monetary value.
- You receive a license to use, display, export, and share your cards for personal, non-commercial purposes. We and our licensors retain ownership of the App, the card frames, templates, brand, and underlying technology.
- Cards may be tagged with optional capture context — the local time of capture and, only if you enable location, a coarse (region-level) weather and terrain/biome tag that shapes gameplay. Location is off by default, you can turn it off anytime, and how this data is collected and used is governed by our Privacy Policy.
- Cards exist within the App. We may need to modify, suspend, or remove cards or features for legal, safety, or technical reasons (see §12), and the App may not be available forever (§13).
7. User-generated content (UGC)
- "UGC" includes card names you create, your public library, and anything else you submit.
- You retain your rights in your UGC, and you grant us a worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute it as needed to operate, moderate, and promote the App (including showing a public library to other users you allow).
- You are responsible for your UGC and represent that you have the rights to it and that it does not violate these Terms or others' rights.
8. Acceptable use
You agree not to:
- Photograph or upload content that is not a real animal in order to abuse the generator, or any content that is illegal, sexual, violent, hateful, harassing, or that depicts identifiable people without consent or that you have no right to capture.
- Infringe anyone's intellectual property, including by attempting to make the generator reproduce third-party characters, logos, or artwork.
- Cheat, tamper with balances or serials, automate captures, exploit bugs, or circumvent Roll limits, rate limits, or payment.
- Harass other users, scam in (future) trades, or misuse public libraries.
- Reverse-engineer, scrape, overload, or interfere with the App or its security.
We use automated and/or human moderation on captured photos, generated images, names, and shared/public content, and may reject, remove, or refuse to mint content, with or without notice.
Zero tolerance for objectionable content and abusive users. There is no tolerance for objectionable, abusive, or infringing user-generated content or for abusive behavior toward other users. You can report content or users, and block any user, from within the App. We review reports and will remove offending content and may suspend or terminate the responsible account, typically within 24 hours. Blocking a user hides their content from you and stops them from interacting with you.
9. Trading / exchange (when available)
When card exchange is available, cards may be exchanged for other cards only — never gifted or sold for money. A trade requires a card from each side. We may warn on lopsided trades, impose cooldowns, and treat completed transfers as final. We are not a party to and not responsible for user-to-user trades beyond providing the feature.
10. Intellectual property
The App, including its name, logos, "Snapari," "Bestiary," "Rolls," "Aura," element names, card frames, templates, software, and design, is owned by us or our licensors and protected by law. Except for the limited licenses in §3 and §6, no rights are granted to you. You may not use our marks without permission.
11. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that generation will always succeed, that the App will be uninterrupted or error-free, or that AI-generated content will meet your expectations. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
12. Suspension & termination
We may suspend or terminate your access, remove content, or revoke virtual items if you violate these Terms or for legal, safety, or operational reasons. You may stop using the App and delete your account at any time. Deleting your account does not cancel an auto-renewing subscription — cancel it in your Apple ID settings first (see §5). Sections that by their nature should survive (e.g. §6, §10, §11, §13, §14) survive termination.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, CARDS, VIRTUAL ITEMS, OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50. Some jurisdictions do not allow these limits, so they may not fully apply to you.
14. Disputes; arbitration; governing law
These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws rules. Any dispute will be resolved by the courts of Vaud, Switzerland. If you are a consumer resident in the EU, the UK, or Switzerland, you keep any non-waivable statutory rights under the consumer protection law of your country of residence, including any right to bring proceedings before your local courts.
15. Apple App Store terms
This section applies when you obtain the App through the Apple App Store. It reflects the minimum terms Apple requires (Schedule 1 of the Apple Developer Program License Agreement). Your use of the App also remains subject to Apple's standard Licensed Application End User License Agreement; where that agreement and these Terms conflict on a point Apple requires, Apple's terms control.
- These Terms are between you and us, not Apple. We, not Apple, are solely responsible for the App and its content.
- Licence. We grant you a personal, non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, including their Family Sharing provisions.
- Maintenance and support. We are solely responsible for support and maintenance. Apple has no obligation to provide any support or maintenance for the App.
- Warranty. We are solely responsible for any warranties, express or implied, to the extent they are not effectively disclaimed. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App.
- Claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property. If a third party claims that the App or your possession and use of it infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Contact. Questions, complaints, or claims about the App should be sent to Ising Digital Sàrl at contact@isingdigital.ch.
- Third-party terms. You must comply with any applicable third-party terms of agreement when using the App.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
16. Changes to these Terms
We may update these Terms; we will post the updated version with a new date and, for material changes, give in-app notice. Continued use after changes means you accept them.
